Service Agreement for CAH Tech Computer Repair LLC
This Service Agreement ("Agreement") is entered into by and between CAH Tech Computer Repair LLC ("we," "our," or "CAH Tech") and the undersigned Customer ("you" or "Customer"). By agreeing to this contract, you acknowledge and accept the terms outlined below for computer repair services provided by CAH Tech.
1. Services Provided
CAH Tech will provide repair, diagnostic, installation, and other technical services on your computer or electronic device as requested. We strive to perform these services in a timely and professional manner.
2. Customer Consent and Authorization
By signing this Agreement, you authorize CAH Tech to:

Enter your property to perform the agreed-upon services.

Access necessary personal data stored on your device to the extent required for the service. This may include, but is not limited to, system diagnostics, data backups, and software installations.

Operate on your device’s hardware and software for purposes such as repair, diagnosis, installation, and any other related services.
3. Customer Acknowledgement of Risk and Limitations of Liability
You understand and accept that:

Data Loss: While we make every effort to avoid data loss, CAH Tech is not liable for any data loss or corruption during the repair process. It is your responsibility to back up all data prior to service.

Accidental Property Damage: CAH Tech is not responsible for any incidental or accidental damage to your property that may occur as a result of technician service. This includes damage to your computer or any property in the vicinity of service.

Accidental Hardware Damage: CAH Tech technicians will handle all devices with care, but we are not liable for any accidental hardware damage that may occur during the course of repairs or diagnostics. Certain repairs, such as opening a device or replacing parts, may carry risks.

Other Unintended Consequences: You agree to accept all risks associated with computer repair, including any unintended consequences such as system instability or other malfunctions following service.
4. Payment Terms

You agree to pay the agreed-upon service fee including the base cost of service ($150) as well as other add-ons such as parts, other services, and extra hours accumulated for the work performed. The exact fee will be determined and communicated prior to starting service and is subject to change after service is complete to account for accumulated hours and add-on services.

You agree to the hourly labor charge ($100) after the initial hour of service which will be billed quarterly ($25) throughout the hour. Any time used in a quarter will be billed fully.

You agree to the hourly charge of data transfer hours ($50) if you are using such service and it will be billed in full if a quarter of an hour is used. (Data transfer hours override normal hourly labor charge for only the time data transfer is being carried out. The normal hourly rate will pause when the data transfer service starts and resume when it ends. There is a minimum charge for data transfer ($50).)

Payment is due upon completion of the service unless otherwise agreed upon in writing.

If the payment is not made as per this Agreement, CAH Tech reserves the right to withhold the release of the repaired device until payment is received.
5. No Guarantee of Results

CAH Tech does not guarantee that all issues will be resolved, or that the services performed will meet all of your expectations. Some repairs may not be feasible or may uncover further underlying issues that were not initially apparent.

You acknowledge that repairs or technical services on older or malfunctioning devices may not restore them to full working order.
6. Indemnification
You agree to indemnify and hold CAH Tech, its technicians, associates, and representatives harmless from any and all claims, damages, losses, or legal expenses resulting from the services provided, including but not limited to:

Loss or corruption of data.

Physical damage to hardware.

Any adverse effects on your device’s performance post-service.
7. Right of Refusal
CAH Tech reserves the right to refuse service for any reason, including but not limited to unsafe work environments, unreasonable demands, or suspicion of illegal activity.
8. Customer Responsibilities
You agree to:

Provide CAH Tech technicians with a safe and accessible workspace.

Disclose any relevant information regarding your device’s history, prior repairs, or known issues.

Cooperate with technicians to ensure they have access to necessary passwords, devices, and tools to perform their work.
9. Termination of Services
CAH Tech reserves the right to terminate services at any time if technicians feel the work is not feasible, unsafe, or if the Customer violates any terms of this Agreement.
10. Acceptance of Risks
By signing this Agreement, you acknowledge that you have read and understand the risks associated with computer repair services, and you accept full responsibility for these risks. You also agree that CAH Tech is not liable for any damages or losses beyond the scope of this Agreement.
11. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the state in which the services are performed.
12. Entire Agreement
This Agreement constitutes the entire agreement between the parties and supersedes any prior agreements or understandings, whether written or oral, relating to the subject matter herein.
